Riding a bicycle is good exercise and can be fun, but when a crash happens, the consequences can be serious. Bikes share the road with motor vehicles which are faster and heavier and less maneuverable. When collisions occur, bicycles afford very little protection, and certainly less than enjoyed by the driver of a car or truck.
You are vulnerable to the mistakes of others on the road. Even the most experienced bike rider has no way to avoid a collision if someone opens a car door in front of you, or cuts you off and stops in front of you, or runs a red light or stop sign, colliding into you and your bicycle.
Bicycle accidents result in some of the most serious injuries I see in my law practice. Injuries routinely suffered in bicycle accidents include broken arms or legs, serious knee and shoulder injury, road rash and permanent scars, and head injuries which can have profoundly serious consequences for the injured bike rider.
Because of the high cost of serious necessary medical treatment, and the high insurance policy limits which cover many drivers on the road, their insurance companies hire aggressive defense attorneys and these kinds of cases can turn into a real fight. You would be wrong to assume that anyone’s insurance company or lawyer is going to take it easy on you, especially if your case involves a permanent injury.
If you or a loved one has been injured in a bicycle accident, there are many, many facts and details that can means the difference between winning the case or ending up with a lower settlement for your injuries than you deserve – or possibly even losing the case altogether.
Identifying all responsible parties and their insurance coverage, obtaining the police report, identifying witnesses and getting complete medical records before they are changed or lost, and compiling clear and compelling evidence of exactly how the injury took place are some of the most important first steps you can take if you or a loved one has been injured in a nursing home.
Any time you are dealing with an insurance company – and in bicycle versus car or truck accident cases, you often are – you must understand that you are dealing with people who spend their every waking hour trying to beat injured people out of their fair settlement for their injuries. There are large amounts of money on the line for the involved insurance companies, so they think nothing of spending money on lawyers to defeat your case.
Hiring the right lawyer – a lawyer experienced in taking real cases to court – is the smartest thing to do if you or a loved one has been involved in a bicycle injury. It is really the only way to make sure that your fight against the insurance companies is fair. But only you can make this important decision that can make or break your case. Only you can act now to protect your rights.
